Six LPA FAQs

A Lasting Power of Attorney, or an LPA, allows someone to appoint a trusted nominee to take care of their affairs should they one day no longer have capacity to do so, owing to illness or injury. In the event that you lose capacity for whatever reason, a trusted nominee can make decisions for you. However, we understand that this can be a big decision, so we are assisting you by answering some frequently asked questions surrounding LPAs.

How do I choose someone?

It must be someone over the age of 18, and someone you trust completely. You should discuss your wishes with this person in advance, so they can act in your best interests should the time come.

How do I go about creating an LPA?

To arrange an LPA, you can visit a solicitor or arrange an LPA online. One option is to look for LPA’s online through Power of Attorney Online or similar providers.

Can I cancel or change my mind?

Should you wish to change your nominee, you’ll need to revoke your existing LPA and apply for a new one by enlisting a solicitor again, according to the Office of the Public Guardian.

How much does it cost?

The cost of registering an LPA with the Office of the Public Guardian is £110. Each solicitor’s office will set their own fee for the costs involved in setting up an LPA.

Are there different types of LPA?

Yes, there are two types. One relates to finance and property and the other, health and welfare. Many people choose to register both, so they are fully covered in the event of losing capacity.

How many attorneys can I appoint?

You can nominate several attorneys, but involving too many could get complicated, so it’s advisable to have no more than four. This may be, for example, several of your adult children. Ensure that all your representatives are people who know each other and get along, in case they are needed to make decisions jointly in future.
